By accessing or using briefly. ("the Service") at sayitbriefly.com or through our mobile applications, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

We reserve the right to update these Terms at any time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

2. Description of Service

briefly. is a podcast insight and reflection application that uses artificial intelligence to help users capture key moments, generate summaries, and engage in guided journaling based on podcast content. The Service is currently in pre-launch, and features may change before and after public release.

3. Eligibility

You must be at least 13 years of age to use briefly. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

4. User Accounts

When you create an account with us, you must provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account at support@sayitbriefly.com.

5. Acceptable Use

You agree not to use briefly. to:

  • Violate any applicable law or regulation.
  • Infringe the intellectual property rights of others, including uploading or sharing copyrighted podcast content without authorisation.
  • Transmit any harmful, offensive, or disruptive content.
  • Attempt to gain unauthorised access to our systems or other users' accounts.
  • Use automated tools (bots, scrapers) to access or extract data from the Service without our prior written consent.
  • Reverse-engineer, decompile, or disassemble any part of the Service.
  • Use the Service for any commercial purpose without our explicit permission.

6. User Content

You retain ownership of any content you create within briefly., including journal entries, notes, and captured insights ("User Content"). By using the Service, you grant us a limited, non-exclusive, royalty-free licence to store and process your User Content solely for the purpose of providing and improving the Service.

You represent that you have all necessary rights to any User Content you submit and that it does not violate any third-party rights or applicable laws.

7. AI-Generated Content

briefly. uses artificial intelligence to generate summaries, insights, and reflection prompts. AI-generated content is provided for informational and personal development purposes only. We do not guarantee the accuracy, completeness, or fitness of AI-generated content for any particular purpose. You are responsible for how you act on any insights provided.

8. Intellectual Property

The Service and its original content, features, and functionality (excluding User Content) are and will remain the exclusive property of briefly. and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

9. Third-Party Services

briefly. integrates with third-party services (such as podcast platforms and AI providers). Your use of such services is governed by their respective terms and privacy policies. We are not responsible for the practices or content of any third-party services.

10. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Limitation of Liability

To the fullest extent permitted by law, briefly. and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid us in the twelve months preceding the claim, or $100 AUD if no payment has been made.

We may suspend or terminate your access to the Service at our sole discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
